as i recollect, Emperor Georgie Boy I proclaimed the United States itself as part of the 'battlefie­ld' after 911.



as far as i know, it hasn't been rescinded.



as such, the Gitmo treatment could apply to any US citizen if it's deemed 'necessary­'. including you or me.



if you want to be a 'strict Constituti­onalist' such as the right boasts and brags about, the Fifth Amendment says, "No person shall be held to answer for a capital, or otherwise infamous crime. . ."



not 'citizen'. . .'person'.



Article I Section 9 says, "The Privilege of the Writ of Habeas Corpus shall not be suspended, unless when in Cases of Rebellion or Invasion the public Safety may require it."



now, i don't see that there's a rebellion going on, unless they count antiwar or antigovern­ment activism (even by the baggers) as 'rebellion­'. and, for all the right's fear and screaming and whining, i don't believe we're under invasion.



so, while it may not be traditiona­l, under a 'strict reading of the Constituti­on' detainees should be allowed hearings in civilian court, including the right of Habeas Corpus.



leastways, i don't see an argument against it, other than the Chicken Littles screaming their heads off. . .
